These Terms of Service (“Terms”) govern your use of Merchwright (the “Service”) operated by Merchwright (“we”, “our”, “us”). By using the Service, you agree to be bound by these Terms.

1. The Service

Merchwright is an AI-powered tool that drafts appeal letters for cross-border e-commerce sellers who have received violations or penalties from platforms including TikTok Shop, Temu, and Shein.

When you submit a case, our AI generates a professional appeal letter based on your inputs, along with an evidence checklist and submission guidance.

2. What We Provide vs. What We Don't

What we provide:

  • A professionally drafted appeal letter delivered within minutes
  • An evidence checklist mapped to your case
  • Submission guidance and escalation tactics

What we don’t provide (and you acknowledge):

  • No guarantee of appeal success. The outcome of any appeal depends on the actual merits of your case and the platform’s review process, neither of which we control.
  • Not legal advice. Merchwright is not a law firm and does not provide legal services. If your case involves substantial financial or legal risk, consult a qualified attorney.
  • Not affiliated with TikTok, Temu, Shein, or any e-commerce platform. We have no special access or influence with these platforms.

3. Pricing and Payment

  • The current price is $10.00 USD per appeal letter (single payment, no subscription).
  • Payment is processed by Creem, our merchant of record.
  • All prices are in USD unless otherwise stated.

4. Refund Policy

24-hour quality refund: If, within 24 hours of receiving your letter, you believe the letter does not meet professional quality standards, contact us at support@merchwright.com and we will issue a full refund.

No outcome-based refunds: We do not issue refunds based on the platform’s decision on your appeal. The appeal outcome is outside our control.

Refunds are processed by Creem and typically appear on your original payment method within 5–10 business days.

5. Your Responsibilities

By using the Service, you agree to:

  • Provide accurate, truthful information about your case
  • Submit only your own case details — not impersonate other sellers
  • Not use the Service to violate any platform’s policies (e.g., submit fraudulent appeals for cases where you knowingly violated policy)
  • Not use the Service for illegal purposes
  • Not redistribute, resell, or commercialize our outputs without permission

You retain ownership of the case information you submit. You grant us a limited license to use that information solely to deliver the Service to you.

6. AI Output Disclaimer

The appeal letters are generated by artificial intelligence. While we have trained our system on platform policies and successful appeal patterns, AI outputs may contain inaccuracies. You are responsible for reviewing the letter before submission to ensure it accurately reflects your case.

7. Limitation of Liability

To the maximum extent permitted by law:

  • We are not liable for any damages arising from the platform’s decision on your appeal
  • Our total liability for any claim related to the Service is limited to the amount you paid us in the 12 months preceding the claim
  • We are not liable for indirect, consequential, or punitive damages including lost profits, lost sales, or business interruption

8. Intellectual Property

The Merchwright service, including its design, system prompts, and underlying technology, is our intellectual property. You may not copy, reverse engineer, or attempt to replicate the Service.

The appeal letters generated for you are yours to use for your own appeal submissions.

9. Termination

We reserve the right to refuse service to any user at our discretion, particularly if we believe the Service is being used for fraudulent or abusive purposes. In such cases, we will refund any unfulfilled payments.

You can stop using the Service at any time. There is no account to cancel.

10. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated by email or by notice on this page. Continued use of the Service after changes constitutes acceptance.

11. Governing Law

These Terms are governed by the laws of the People’s Republic of China (excluding conflict of law principles). Any disputes will be resolved in the courts of Beijing, China.

If you are a consumer located in the European Union or another jurisdiction with stronger consumer protection laws, you retain the protections of your local laws to the extent they cannot be waived.
